Please read these Terms and Conditions carefully. They govern your use of Fairy Service, LLC's website and services and constitute a legally binding agreement between you and Fairy Service, LLC.

1. Acceptance of Terms

By accessing www.fairyservice.com, using our services, or engaging Fairy Service, LLC ("we," "us," "our," or "Fairy Service") as your concierge, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, together with our Privacy Notice and any other policies referenced herein. If you do not agree to these terms in full, you must not use our website or services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated revision date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.

2. Definitions

  • "Client," "you," or "your" refers to any individual, family, or corporate entity that uses or requests our services.
  • "Services" refers to all luxury concierge, lifestyle management, travel coordination, event planning, relocation assistance, notary facilitation, and related services provided by Fairy Service.
  • "Third-Party Provider" refers to any external supplier, vendor, hotel, airline, venue, or contractor engaged to fulfill a Client's request.
  • "Agreement" refers to the confirmed booking, service proposal, or engagement letter signed or accepted by the Client and Fairy Service.
  • "Fee" or "Fees" refers to all charges associated with our Services, including concierge fees, membership fees, and any service charges.

Fairy Service, LLC is a Florida limited liability company specializing in bespoke concierge and lifestyle management services. We are a registered Seller of Travel in the State of Florida ( Fla Seller of Travel no. ST41351). Our registered office is located in Orlando, Florida, USA.

4. Services Description & Scope

Fairy Service provides personalized, high-end concierge services tailored to each Client's unique preferences and requirements. Our services include, but are not limited to:

  • Travel Design & Coordination: itinerary planning, luxury accommodation sourcing, private aviation and yacht charter coordination, ground transportation, restaurant reservations, and bespoke travel experiences
  • Villa & Estate Management: sourcing, inspecting, and managing luxury villa rentals and private estate stays worldwide
  • Event Planning: private celebrations, corporate events, milestone occasions, and exclusive gathering coordination
  • Relocation Assistance: settling-in services, school searches, home setup coordination, and local orientation for individuals and families moving to or from the United States and Italy
  • Notary Facilitation: bilingual coordination of notarial acts, document authentication, and legal document preparation between U.S. and Italian jurisdictions
  • Lifestyle Management: personal shopping, wellness arrangements, entertainment bookings, and day-to-day personal assistance

All Services are subject to availability, seasonality, and the cooperation of Third-Party Providers. Fairy Service does not guarantee the availability of any specific product, property, or experience until a booking is confirmed in writing.

5. Eligibility

Our Services are available to individuals aged 18 years or older with legal capacity to enter into binding contracts. By using our Services, you represent and warrant that you meet these requirements and that all information you provide is accurate, current, and complete.

For corporate memberships and business accounts, the individual registering on behalf of the entity represents that they have authority to bind the organization to these Terms.

6. Bookings, Confirmations & Agreements

All service requests must be submitted in writing via email, through our website inquiry form, or by telephone with subsequent written confirmation. A binding Agreement is formed only when:

  • Fairy Service issues a written service proposal, itinerary, or confirmation;
  • The Client accepts the proposal in writing (email reply or signed agreement); and
  • Any required deposit or payment is received and cleared, where applicable.

Quotations and proposals are valid for the period stated therein (typically 7 days) and are subject to change if not accepted within that timeframe. Prices are based on information available at the time of quotation and may be adjusted if circumstances change before confirmation.

7. Fees, Payments & Pricing

Fairy Service operates on a fee-for-service and membership basis. Our fee structure is transparent and communicated clearly before any commitment:

  • Concierge Fees: A service fee may apply to each booking or request, calculated as a percentage of the transaction value or as a fixed flat fee depending on complexity and scope. This will be disclosed in your proposal.
  • Membership Fees: Annual or monthly membership fees apply for our Individual and Corporate membership tiers, as detailed in the membership proposal.
  • Third-Party Costs: All costs charged by Third-Party Providers (hotels, airlines, venues, suppliers) are separate from our concierge fees and are typically payable directly to the provider or through us as your agent, as agreed.
  • Currency: Fees are generally quoted in U.S. Dollars (USD) unless otherwise agreed. Currency conversion fees, if any, are the Client's responsibility.

Payment Terms: Unless otherwise agreed in writing, invoices are due within 14 days of issuance. For bookings requiring immediate confirmation (e.g., exclusive accommodations, peak-season travel), payment in full or a deposit may be required at the time of booking. We accept bank transfer, major credit cards, and other methods as communicated.

Late Payments: Overdue invoices may incur a late payment charge of 1.5% per month (or the maximum permitted by law) on the outstanding balance. We reserve the right to suspend services for accounts with significant arrears.

8. Deposits, Cancellations & Refunds

Cancellation policies vary depending on the nature of the service, the Third-Party Provider's terms, and the timing of cancellation:

  • Concierge Service Fees: If you cancel a confirmed service request before work has commenced, any concierge fees paid may be refundable minus an administrative charge. Once substantial work has begun (e.g., bookings confirmed with suppliers), service fees are non-refundable.
  • Third-Party Bookings: Refunds for hotel stays, flights, events, and other third-party services are governed by the specific provider's cancellation policy. We will communicate these terms at the time of booking. Fairy Service cannot refund amounts that the Third-Party Provider refuses to return.
  • Membership Cancellations: Annual memberships may be canceled subject to the terms outlined in the membership agreement. Fees paid are generally not refundable except where required by law.
  • Force Majeure Events: In the event of cancellations due to circumstances beyond reasonable control (pandemic, natural disaster, war, government restriction), we will work diligently with Third-Party Providers to secure credits, postponements, or partial refunds. Our concierge fees may be applied as a credit toward future services.

All cancellation requests must be submitted in writing. Refunds, if approved, are typically processed within 14–30 business days.

9. Client Responsibilities & Conduct

By engaging Fairy Service, you agree to:

  • Provide accurate, complete, and timely information to enable us to fulfill your requests effectively
  • Respond to inquiries and approve proposals within reasonable timeframes to avoid missed opportunities
  • Comply with all applicable laws, regulations, and Third-Party Provider rules during the course of service delivery
  • Behave respectfully toward our staff, partners, and suppliers
  • Ensure that all travel documents (passports, visas, health certificates) are valid and obtained prior to departure
  • Obtain appropriate travel and health insurance for all bookings
  • Inform us promptly of any changes to your circumstances, preferences, or requirements that may affect confirmed services

Fairy Service reserves the right to terminate services immediately, without refund, if a Client engages in unlawful, abusive, fraudulent, or disruptive behavior.

10. Confidentiality & Privacy

Fairy Service operates on a foundation of absolute discretion and trust. All information shared by Clients — personal details, preferences, financial information, travel plans, and lifestyle choices — is treated as strictly confidential.

We will not disclose, share, or sell your personal information to unauthorized parties, except as necessary to fulfill your service requests (e.g., sharing your name with a hotel for a reservation) or as required by law. Clients also agree to respect the confidentiality of any proprietary information, supplier contacts, or internal arrangements disclosed by Fairy Service in the course of service delivery.

11. Third-Party Services & Liability

Fairy Service acts as an independent agent and coordinator on behalf of our Clients. While we exercise exceptional care in selecting and vetting Third-Party Providers, we do not own, operate, or control the hotels, airlines, venues, or suppliers we recommend and book.

We are not liable for:

  • The acts, omissions, negligence, or defaults of Third-Party Providers
  • Injury, loss, damage, delay, or inconvenience caused by Third-Party Providers or force majeure events
  • Changes to Third-Party offerings, amenities, or standards after booking
  • Discrepancies between Third-Party descriptions and actual experiences

Our liability is limited to the concierge fees actually paid by you for the specific service in question, unless otherwise required by applicable law. We strongly recommend that all Clients obtain comprehensive travel and liability insurance.

12. Intellectual Property

All content on the Fairy Service website — including text, images, logos, designs, itineraries, proposals, and other materials — is the intellectual property of Fairy Service, LLC or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of our content without prior written permission. Custom itineraries and proposals prepared for you are for your personal use only and may not be resold, shared with third parties, or used for commercial purposes without consent.

13. Disclaimers & Warranties

Fairy Service provides its Services on an "as is" and "as available" basis to the fullest extent permitted by law. While we strive for perfection in every detail, we do not warrant that:

  • The website will be uninterrupted, error-free, or completely secure
  • Any specific outcome, experience standard, or result will be achieved
  • Third-Party Providers will meet any particular quality benchmark (though we endeavor to select only the finest partners)

We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fairy Service, LLC and its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, emotional distress, or reputational harm, arising out of or in connection with your use of our Services or website.

Our total aggregate liability for any claim arising from or related to our Services shall not exceed the total amount of fees actually paid by you to Fairy Service for the specific service giving rise to the claim during the 12 months preceding the event.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Fairy Service, LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your misuse of our Services or website
  • Your infringement of any third-party rights, including intellectual property or privacy rights
  • Any harm or damage caused to Third-Party Providers during the delivery of Services

16. Force Majeure

Fairy Service shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, war, terrorism, civil unrest, government actions, labor disputes, strikes, utility failures, or significant disruptions to transportation or communication systems.

In such circumstances, we will make reasonable efforts to mitigate the impact on your Services and, where possible, offer alternative arrangements or credits for future use.

17. Governing Law & Jurisdiction

These Terms and any dispute arising from or relating to them shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles.

Any legal action, suit, or proceeding arising out of or relating to these Terms or our Services shall be brought exclusively in the state or federal courts located in Orange County, Florida. You consent to the personal jurisdiction and venue of such courts and waive any objection to jurisdiction or venue.

18. Dispute Resolution

Before initiating any formal legal proceedings, the parties agree to attempt in good faith to resolve any dispute through informal negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue formal remedies as permitted by these Terms.

For qualifying disputes, Fairy Service may, at its discretion, offer mediation or arbitration as a cost-effective alternative to litigation. Participation in mediation or arbitration is voluntary unless otherwise agreed in a separate written agreement.

19. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Fairy Service may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.

21. Entire Agreement

These Terms, together with our Privacy Notice, membership agreements, and any written service proposals or confirmations, constitute the entire agreement between you and Fairy Service regarding the subject matter herein and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written.

22. Changes to These Terms

We may update or revise these Terms periodically to reflect changes in our Services, legal requirements, or business practices. The most current version will always be posted on this page with the "Last updated" date. We encourage you to review these Terms regularly. Material changes may be communicated to active Clients by email where appropriate.
